Eligibility to Use

Account & Registration Obligations

Your Information is defined as any information you provide to us in the registration, buying or listing process, in the feedback area or through any e-mail feature or a written letter or form mailed or submitted to any of our stores and offices. We will protect your Information in accordance with our Privacy Policy. If you use the Website, you are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. atun.in does not want to receive confidential, proprietary or trade secret information through this Website (excluding information related to any order you submit). Please note that any information, materials, suggestions, ideas or comments sent to atun.in will be deemed non-confidential. By submitting any such information, you are granting atun.in an irrevocable and unrestricted license to use, modify, reproduce, transmit, display and distribute such materials, information, suggestions, ideas or comments for any purpose whatsoever. However, we will not use your name in connection with any such materials, information, suggestions, and ideas or comments unless we first obtain your permission or otherwise are required by law to do so.

Terms of sale

In case you make payment from your order on www.atun.in, through Bank Transfer, you need to mention the Order ID as the payment reference while making the payment and email the proof of payment to us at info@atun.in.

In case there is a problem in receipt of the payment due to a mistake done by you or your bank i.e, Beneficiary name, account number, amount of any other, it will be your responsibility to deal with your bank to get the same corrected. www.atun.in will process the order only once the payment is received into our account.

You are requested to allow us a minimum of 2-3 working days to receive the online payment. There might be a delay in receipt/confirmation of payment on weekends and holidays.

In case payment is not received within 7 days of order, the order will be cancelled on the 8th day.

Terms of delivery

The terms of Shipping & Delivery Policy must be understood. If you do not agree to the terms contained in this Shipping & Delivery Policy, you are advised not to accept the Terms of Use and the Delivery Policy. The terms contained in this Shipping & Delivery Policy shall be accepted without modification and accordingly, to be bound by the terms contained herein.

Team A.T.U.N. is committed to deliver all orders with good quality products and packaging within a span of 3-4 working days (excluding Sundays & Public holidays) under normal circumstances. A.T.U.N. (“All Things Uber Nice”) makes all commercially reasonable endeavours to ensure that the Product(s) are delivered to end users in a timely fashion. To ensure that the order reaches in a good condition, in the shortest span of time, we ship through reputed logistics companies like Delhivery, FedEx, Shiprocket, etc.

Shipping Charges

A.T.U.N. has a non-refundable flat shipping charge of INR 99 per order. All online orders carry a INR 99 shipping charge. For orders placed with Cash on Delivery service, a non-refundable cover fee of INR 75 is levied apart from the shipping charges. The prices are all inclusive of taxes. A.T.U.N. partners with third party logistic service providers separate and distinct from A.T.U.N., to effectuate product(s) delivery to end users. Details of the Logistic Partner who will be processing the delivery of the order will be provided to the end user through email along with the tracking number. The approximate date of delivery shown by the delivery partner is merely an approximation based on their reputation. A.T.U.N. shall not be liable for delay in delivery by third party Logistic Partners.

Prior to making payments for the purchase of product(s), the user will be prompted to provide a shipping address. While entering shipping address details, the user should ensure to provide correct, complete and accurate information along with landmarks if any to aid delivery. A.T.U.N. shall not, under any circumstance, be liable for any failure/delay in delivery of the purchased product(s) arising out of the user’s failure to provide correct, complete and/or accurate information.

Order Delivery Timelines

Under normal circumstances, orders are dispatched in 3-4 working days (excluding Sundays and Public Holidays) after the customer has placed the order. Upon the successful placing of an order and after A.T.U.N. has successfully handed over the purchased product(s) to its Logistic Partner, the end user will receive a unique tracking identity number through email. The user may use the tracking number on the website of the Logistic Partner to check the status of the purchased Product(s) and the expected date of delivery. The user can also check the order on www.atun.in by simply logging in to their account.

Normally, most orders are delivered within 7 working days(after dispatch) across India. A maximum of 3 (three) attempts shall be made to deliver order to the end user. Should the user continue to remain unavailable after 3 (three) attempts, A.T.U.N. reserves the right to cancel the order at its sole discretion. In case of a Cash on Delivery order, the customer will not be allowed to place another Cash on Delivery order on the website.

While A.T.U.N. shall make reasonable endeavours’ in ensuring that purchased product(s) is delivered to its users in a timely manner, delivery may be delayed on account of

• Unsuitable weather conditions;
• Political disruptions, strikes, employee-lockouts, Govt. directed lockdowns, etc.
• Acts of God such as floods, earthquakes, etc.; and
• Other unforeseen circumstances.

In such events of delay, A.T.U.N. shall make reasonable attempt at proactively intimating the end user by writing to end user’s registered email account. Further, A.T.U.N. shall be under no obligation to compensate the user for any mental agony or any tortuous claim that may otherwise arise because of a delay in the shipment and delivery.

Return and exchange of purchased Product(s) shall be carried out by A.T.U.N. reverse-logistics partners, which are separate and distinct from A.T.U.N. Please note that A.T.U.N. shall not be liable for any act(s) and/or omission(s) of such reverse logistics partners. What if I have received the product in damaged condition?

If you have received the Product in a bad condition you may drop us an email on info@atun.in mentioning the Order# alongwith the screenshots of the damage, so we can get the same cross-checked by the QC team and A.T.U.N. will ensure that a new order is placed and sent with no additional cost.

Usage Restrictions

You shall not use the Website for any of the following purposes:

• Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
• Transmitting material that encourages conduct that constitutes a criminal offence results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
• Gaining unauthorized access to other computer systems.
• Interfering with any other person’s use or enjoyment of the Website.
• Breaching any applicable laws.
• Interfering or disrupting networks or websites connected to the Website.

Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

Quantity Restrictions

Atun.in reserves the right, at our sole discretion, to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit / debit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied. Atun.in also reserves the right, at our sole discretion, to prohibit sales to any one as it may deem fit.

Pricing Information

While atun.in strives to provide accurate product and pricing information, pricing or typographical errors may occur. atun.in cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, atun.in shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, atun.in may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and atun.in will have the right to modify the price of the product and contact you for further instructions using the e-mail address provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that atun.in accepts your order the same shall be debited to your credit / debit card account and duly notified to you by email that the payment has been processed. The payment may be processed prior to atun.in dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit / debit card/ bank account.

We strive to provide you with best value. However, sometimes a price online may not match the price in a store in your particular geographic region and store pricing may sometimes differ from online prices. Prices and availability are subject to change without notice.

Cancellation by atun.in

In case payment is not received within 7 days of order, atun.in will cancel the order on the 8th day.

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will inform you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is cancelled after your credit / debit card has been charged or bank transfer has been done, the said amount will be reversed back in your Card/bank Account.

We will seek authorization on your Card for the aggregate amount of the order placed by you, however, we may charge your card (capture) only with the amount corresponding to the actual portion of the order that we are able/willing to fulfill, and any associated shipping charges/taxes and levies etc. Any surplus amount, for which we might have originally sought and received an authorization on your card from your Card Issuer, if not captured by us in the time period stipulated by our Merchant Banker, will not be captured / charged. If however the same is charged to your card / bank account in error, we will refund it as soon as the same is realized by us or brought to our notice, whichever is sooner. Atun.in reserves the right to capture / charge your card to the full or partial authorized amount for the concerned order.

Exchange/Return Policy

IMPORTANT:

• In case you want to exchange/return, kindly raise a request within the 15 days from date of delivery of your order. Please rest assured, we shall process it subject to usual quality inspection. Kindly note that the tags should be intact and product(s) should be unused.

• It can take up to 7 days for a reverse pickup to be done, once a customer raises a request for the same. And up to 7 to 10 days for the returned product to reach us.

• Refund will be issued by A.T.U.N. once the returned goods reach us and have been checked and confirmed by A.T.U.N. quality team. In case the product is found used or damaged, A.T.U.N. holds the right to limit or refuse the refund.

• No refunds will be issued for COD orders, only website credit will be given by way of Vouchers which can be redeemed on our website www.atun.in. Such vouchers will NOT have any Expiry limit.

• Refunds for Pre-paid orders will be issued within 15 days of receipt of the cancellation request or returned merchandise by A.T.U.N., vide the same method used by the customer while making the purchase.

Financial Details

You agree, understand and confirm that the credit / debit card details or other financial details provided by you for availing of services on atun.in will be correct and accurate and you shall not use the credit /debit card or financial facility which is not lawfully owned / obtained by you. You also understand that any financial information submitted by you is directly received by our acquiring bank and not stored by atun.in. atun.in will not be liable for any credit / debit card fraud. The liability for use of a card fraudulently will be on you and the onus to ‘prove otherwise’ shall be exclusively on you. All information collected by us shall be governed as per our Privacy Policy.

Fraudulent/Declined Transaction

atun.in and its associated acquiring bank or financial institutions reserve the right to recover the cost of goods, collection charges and legal proceeding fees from persons using the Website fraudulently. atun.in and its associated acquiring banks or financial institutions reserve the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or acts or omissions in breach of these terms and conditions.

Electronic Communications

When you visit the Website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Website. Sizing

Before placing an order you should check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item’s description.

Size Charts have been provided alongside every product and we understand the customer has checked the same and chosen their required size carefully. No request for exchange of size will be accepted.

We do not do alterations of measurements/fit etc for online orders.

Entire Agreement

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between you and atun.in with respect to the atun.in websites/services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and atun.in with respect to the atun.in websites/services. Atun.in’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.

Governing Law & Jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Gurgaon shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by NEW V.K.INTERNTIONAL. and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in GURGAON. The High Court of judicature at Gurgaon alone shall have the jurisdiction and the Laws of India shall apply.

Modification of Terms & Conditions of Service

Atun.in may at any time modify the User Agreement without any prior notification to you. Subsequent to any modification of the User Agreement, we will inform you of the modifications in the User Agreement via e-mail at the address provided by you while registering on atun.in. You can access the latest version of the User Agreement at any given time on atun.in. You should regularly review the User Agreement on atun.in. In the event the modified User Agreement is not acceptable to you, you should discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the terms of modified User Agreement.
